Introduction & Brand StatementThese Terms & Conditions govern participation in private cultural programs organized in Peru by Asociación Irake para la Amazonia (a Peruvian non-profit civil association registered in the Registro de Personas Jurídicas de Lima; hereinafter the “Association”), with the support of an independent commercial entity (the “Operator”) and independent Partner Providers. The Programs may also be presented to the public under the “APL Journeys” brand, an informational and marketing platform that is not a legal entity, is not a party to this Agreement, and does not provide services or collect contributions. By using the Website and/or applying to participate, you accept these Terms & Conditions.2. Definitions- Association: Asociación Irake para la Amazonia, the organizer of the Programs.
- Operator: an independent commercial entity engaged to administer registrations and contributions and to provide ancillary logistics services in connection with the Programs. The Operator does not conduct or supervise any ceremony or cultural activity of the Program.
- Partner Providers: independent entities or professionals (for example, screening or other ancillary services) that may serve Members under their own contracts and terms.
- Website: irake-project.org and its sub-pages — the Association’s official website, on which these Terms & Conditions, the Privacy Policy and any related notices are published.
- APL Journeys / APL Platform: the brand and informational/marketing platform (apljourneys.com) under which the Programs may be presented to the public. APL Journeys is not a legal entity, is not a party to this Agreement, and does not provide services or collect contributions.
- Member / Participant / You: an individual accepted by the Association into a specific Program after the suitability review described in Section 4, on the legal basis of Articles 4.15 and 4.17 of the Association’s Estatuto. The status of Member is a Program-access status and is distinct from the status of asociado (defined in Article 24 of the Estatuto), which is granted exclusively by resolution of the Asamblea General under Articles 25 and 28 of the Estatuto and is not granted by these Terms & Conditions.
- Program: private cultural and educational activities organized by the Association in Peru, including traditional ceremonies with master plants (such as ayahuasca), master plant dietas, educational workshops and related community activities.
- Program Tiers: the names shown on the Website to identify different scopes of Program services. Accommodation configuration correlates with a tier as a logistical element and is not a stand-alone lodging offer.
- Facilitation Team: invited tradition-holders (maestros), cultural guides and support staff, who act exclusively in a cultural and educational support role.
- Waiver: the Participant Declaration, Informed Consent and Release Agreement applicable to the relevant Program (Waiver A — Ayahuasca Ceremonies; Waiver B — Master Plant Dieta), which the Participant must sign prior to participation.
3. Scope & AcceptanceThese Terms & Conditions govern Website use, Association membership, registration and contributions for the Programs, and the Participant’s participation in the Programs in Peru. Services delivered by Partner Providers are governed exclusively by their own terms. You confirm you are at least twenty-one (21) years of age and accept these Terms & Conditions in full.4. Membership & Eligibility4.1 Legal Basis & DistinctionMembership under these Terms & Conditions is granted by the Association in the exercise of its cultural mission, on the legal basis of Articles 4.15 and 4.17 of its Estatuto (organisation of retiros with master plants; reception of foreign participants at its events). Membership is a Program-access status only. It does not confer the status of asociado under Article 24 of the Estatuto, and does not grant any governance, voting, electoral or economic right within the Association. Acceptance into a Program, signature of any Waiver and payment of any amount shall be construed solely as administration of the Member category, not as admission as asociado.4.2 Application & Suitability ReviewMembership is subject to the submission of the registration form and a suitability review by the Association on cultural, health and safety grounds. Acceptance is at the sole discretion of the Association. Successful screening allows the Applicant to participate in a specific Program; it does not create any formal membership status within the Association.4.3 ActivationMembership for a given Program becomes active once the Applicant has been accepted, has signed the applicable Waiver, and has paid the initial contribution and any other amount due at the time of registration.4.4 Members-Only Access; Suspension & Termination for CauseOnly Members whose membership for the relevant Program is active may participate in the Programs. Membership may be suspended or terminated for breach of these Terms & Conditions, of the applicable Waiver, of the Code of Conduct, or of safety protocols. A material breach — including, without limitation, breach of safety protocols, of the Waiver, of the Code of Conduct, of confidentiality, harassment, violence, theft, unauthorised possession or use of substances, or any conduct endangering the Member or others — may result in immediate suspension or termination of the Membership without refund. A minor breach may, at the discretion of the Facilitation Team, result in a warning. Such suspension or termination is a contractual action and does not constitute an “exclusión de asociado” within the meaning of Article 29 of the Estatuto.4.5 Age & LanguageMinimum age twenty-one (21). Sufficient command of English (or another language designated by the Association) is required.4.6 Duration & Automatic TerminationMembership is granted for the specific dates of the Program. It begins on the first day of the Program and terminates automatically at the end of the last day (or on earlier voluntary departure or termination for cause), without further notice. Confidentiality, data-processing consent, image and recording authorisation, and the release of liability obligations survive termination, as set out in Sections 16 (Data Protection), 17.1 (Confidentiality), 17.2 (Image, Audio & Video) and 20.3 (Limitation of Liability) of these Terms & Conditions and in the applicable Waiver. Participation in a future Program requires a new application and a new suitability review.5. Nature of Activities5.1 Cultural PurposeThe Programs are private, non-commercial cultural gatherings for Members, conducted in accordance with the Association’s Estatuto and under Peru’s cultural-heritage framework for the traditional use of ayahuasca, recognized by Resolución Directoral Nacional N° 836/INC of 24 June 2008 as Patrimonio Cultural de la Nación.5.2 No Sale or Marketing of SubstancesNeither the Association nor the Operator sells, markets or prices per dose, per ceremony or per portion any plant preparation or substance. Plant preparations are administered solely within the private, members-only cultural context of the Programs.5.3 No Medical or Psychotherapy ServicesThe Association does not provide medical care, psychiatric treatment or psychotherapy. The Programs are cultural and educational; they do not substitute for medical advice or therapeutic treatment.5.4 Voluntary ParticipationAll activities are voluntary; Members may opt out of any specific activity at any time. Opting out does not entitle the Member to a refund.6. Safety & Participation6.1 Personal ResponsibilityYou are solely responsible for deciding whether to participate in any activity and for your physical, mental and emotional well-being before, during and after the Program.6.2 Health DisclosureThe Participant must answer all screening questions truthfully and disclose every relevant medical factor, medication, supplement and substance used. Detailed health and pharmacological requirements (including contraindicated substances and wash-out periods) are set out in the applicable Waiver. Providing incomplete or inaccurate information may result in immediate exclusion from the Program without refund.6.3 Right to Decline or Pause ParticipationThe Association may decline, pause or terminate a Member’s participation if, in its good-faith judgment, doing so better aligns with safety protocols, the well-being of the group or applicable law. The exercise of this right does not entitle the Member to any refund beyond what is expressly provided in Section 11.6.4 Emergency ResponseThe Association maintains basic emergency-response protocols, including a designated emergency contact within the Facilitation Team and identified routes to the nearest medical facility. The Association does not undertake to maintain on-site medical personnel or equipment. Any cost of medical attention, transportation, evacuation, repatriation, hospitalization or medication is the sole responsibility of the Participant (see Section 13).7. Code of ConductMembers agree to: (a) follow the instructions of the Facilitation Team and the rules of the venue; (b) respect Members, staff, traditional practitioners and host communities (no harassment, threats, violence or theft); (c) refrain from bringing prohibited substances or items, and from consuming alcohol or recreational drugs during the Program; (d) respect the privacy and confidentiality of group settings; (e) abstain from sexual activity during the Program and any post-dieta restriction period communicated by the maestro; (f) follow diet and preparation guidance; and (g) refrain from using recording devices during ceremonies without prior written authorisation. Material breaches of this Code of Conduct (including but not limited to (b), (c), (d), and (g), and any conduct that endangers the Member or others) may result in immediate removal from the Program and termination of membership without refund. Minor breaches may, at the discretion of the Facilitation Team, result in a warning.8. AccommodationAccommodation for the Program is arranged at licensed hospitality establishments in Peru, under standard rental or service agreements signed by the Operator. The Association does not operate as a hotel and does not market accommodation as a stand-alone service. The Participant has no direct contractual relationship with the underlying venue providers.9. Program Tiers & Pricing Presentation9.1 Program TiersLabels shown on the Website identify different Program tiers with varying scopes of services. The accommodation framework is described in the definition of Program Tiers in Section 2.9.2 Planning Summary OnlyIndicative contribution amounts shown on the Website are a planning summary of the overall experience. The display of any combined figure on the Website does not create a single bundled contract or a public-package sale, and shall not be construed as the marketing of a tourist package under any consumer-protection or tourism statute.10. Contributions & Payment10.1 ContributionsContributions for Program participation are administered through the Operator. Payment instructions, methods, currencies and deadlines are notified by the Operator in writing at the time of registration. Applicable taxes, bank charges and payment-processor charges may be passed on to the Participant. Services delivered by Partner Providers are contracted and administered separately by each Partner Provider under its own terms.10.2 Initial Contribution & ConfirmationRegistration is confirmed once the initial contribution and any other amount due at the time of registration have been received. The initial contribution is non-refundable except as expressly stated in Section 11 or as required by mandatory consumer law.10.3 What Is NOT IncludedUnless expressly stated in the Operator’s written registration confirmation, the following are NOT included in the indicative contribution amount and remain the sole responsibility of the Participant:- international and domestic flights;
- visas, immigration and exit fees, vaccinations and any travel formalities;
- comprehensive international medical, travel and emergency-evacuation insurance for the entire stay in Peru (mandatory — see Section 13);
- off-schedule transfers, individual airport pick-ups or drop-offs outside the published Program schedule;
- personal expenses, telecommunications, additional excursions, gifts; and any cost of medical attention, hospitalization, evacuation, repatriation or medication.
11. Cancellations, Changes & Refunds11.1 Program ParticipationGiven the private, limited-capacity, members-only nature of the Programs, contributions for Program participation are generally non-refundable, except as expressly stated in Section 11.2 (Force Majeure) or as required by mandatory consumer law.11.2 Force Majeure & CreditIn the event of a Force Majeure Event (Section 12) preventing the Participant from attending or the Association/Operator from delivering the Program, the Participant will be offered, where practicable, (i) the option to transfer the registration to a future Program (within twelve (12) months) or (ii) a credit for the amount contributed net of non-recoverable Program expenses. Cash refunds are not granted under Force Majeure.11.3 Transfer of RegistrationThe Participant may request in writing, no less than sixty (60) days prior to the Program start date, the transfer of the registration to a future Program of the same or equivalent format, subject to availability and to any difference in the indicative contribution amount. Substitution of the Participant by a third party is not permitted, in order to preserve the integrity of the screening protocol.11.4 Peruvian Consumer Law NoteWhere the rules of Ley N° 29571, Código de Protección y Defensa del Consumidor apply, the Participant acknowledges that the Programs are private cultural gatherings on dated periods with limited capacity, prepared logistics and traditional ceremonial cycles, and are not a public consumer tourist package. Nothing in this Section limits any non-waivable consumer right of the Participant or the right to file a claim with INDECOPI.11.5 No-Show, Late Arrival, Early DepartureNo-shows, late arrivals, voluntary early departure and removal from the Program for breach of the Code of Conduct, of safety protocols or of the Waiver shall not entitle the Participant to any refund.12. Schedule, Modifications & Force MajeureSchedules and itineraries published on the Website are indicative and may be adapted to group needs, venue conditions, weather, cultural considerations, safety protocols or instructions of the traditional practitioners. Neither the Association nor the Operator shall be liable for any delay, modification, interruption or failure to perform resulting from events beyond their reasonable control (“Force Majeure Event”), including, without limitation, natural disasters, epidemics or pandemics, governmental orders, border closures, war, civil unrest, transport failures or venue unavailability. In such cases, the Association and the Operator may modify, postpone, relocate or cancel all or part of the Program, with the remedies set out in Section 11.2.13. Travel, Insurance & VisasThe Participant is solely responsible for international and domestic travel, valid passport and any required visa, and for holding comprehensive international medical and travel insurance covering accident, illness, hospitalization, medication, medical evacuation and repatriation for the entire stay in Peru. The Association and the Operator do not arrange insurance and shall not be liable for any travel disruption or third-party performance failure. The Operator may require evidence of valid insurance prior to the start of the Program.14. Partner Providers & Indemnification14.1 Partner ProvidersPartner Providers act independently and are not agents, employees or joint venturers of the Association or of the Operator. The Participant’s relationship with each Partner Provider is governed exclusively by that Partner Provider’s contracts, policies and governing law. Neither the Association nor the Operator shall be liable for any act or omission of any Partner Provider.14.2 Indemnification by the MemberThe Member shall indemnify and hold harmless the Association, the Operator, the Facilitation Team and any Partner Provider, and their respective officers, employees, agents and contractors, from and against any loss, damage, claim, demand, expense or legal cost (including reasonable attorneys’ fees) arising out of or in connection with: (i) the Member’s material breach of these Terms & Conditions, of the Code of Conduct or of the applicable Waiver; (ii) any unlawful act or omission of the Member during or in connection with the Program; (iii) any damage caused by the Member to venue property, third parties or other Members; or (iv) any unauthorised disclosure by the Member of confidential or sacred content of the Program. This indemnity does not apply to claims arising from the wilful misconduct (dolo) or gross negligence (culpa inexcusable) of the Association or the Operator, as expressly preserved by Article 1328 of the Peruvian Civil Code, nor to claims that cannot be subject to indemnity under Peruvian mandatory law.15. Website UseYou agree not to misuse the Website (including, without limitation, uploading malicious code, infringing intellectual-property rights, harassing other users or scraping content for unsolicited purposes). Access may be suspended for maintenance or any reason beyond the reasonable control of the Association or the Operator.The Website and its content are provided “as is” and “as available”, without warranty of any kind, express or implied, including, without limitation, any warranty of accuracy, completeness, availability, fitness for a particular purpose or non-infringement. Neither the Association nor the Operator shall be liable for any loss or damage arising from reliance on Website content; the binding details for any Program are those set out in the Operator’s written registration confirmation.16. Data ProtectionPersonal data of the Participant is processed in connection with the Programs in accordance with Ley N° 29733, Ley de Protección de Datos Personales and its complementary regulations. Detailed information on data categories, purposes, retention, international transfers, data subject rights and contact for data-protection matters is set out in the Privacy Policy published on the Website, which forms an integral part of these Terms & Conditions. Until the Privacy Policy is published on the Website, the data-processing principles set out in this Section apply. By accepting these Terms & Conditions, the Participant consents to the processing and international transfer of their personal data as described in the Privacy Policy, in accordance with Article 15 of Ley N° 29733. Rights of access, rectification, cancellation and opposition (derechos ARCO) may be exercised by writing to Asociacion-Irake@pm.me.17. Media, IP & Confidentiality17.1 ConfidentialityMembers agree to respect the privacy and confidentiality of other Members. Unauthorized disclosure, recording, reproduction or distribution of any personal experience, traditional song (ikaro), prayer, ceremonial teaching or sacred content shared during the Program is strictly prohibited and may result in immediate expulsion without refund and/or liability for damages.17.2 Image, Audio & Video - Privacy by DefaultThe Association may take photographs and audio or video recordings during the Program. The Member’s consent for the use of their image, voice and recordings is granted (or denied) by the corresponding box ticked by the Member in the applicable Waiver (Section XII).Photographs and recordings are taken primarily for the benefit of the participating Members and are shared privately within a closed Program group accessible only to those Members (for example, a private Telegram channel created for that Program).Photographs (still images). Where the Member has expressly authorized the use of their image in the applicable Waiver, the Association may use such photographs for informational, educational and communication purposes related to the Programs. Where the Member has not authorized such use, the Association may still use such photographs externally only if the Member’s face is fully and recognisably obscured (for example, by means of a cartoon emoji or equivalent visual mask) so that the Member cannot be identified by any third party.Audio and video recordings. The Association shall not publish any audio or video recording showing or featuring a Member who has not expressly authorized such use. Where a recording features two or more Members and any one of them has not authorized, the Association shall either refrain entirely from publishing the recording or edit it so as to fully and permanently remove any portion featuring the Member who has not authorized.Right of withdrawal. The Member may at any time request, by writing to Asociacion-Irake@pm.me, the removal of any photograph, audio or video recording in which they appear from any platform or channel under the Association’s control. The Association shall comply with such request within a reasonable period (typically not exceeding thirty (30) days).17.3 Website ContentWebsite content (text, images, designs, video, audio) is owned by or licensed to the relevant rights-holders and may not be reproduced or distributed without prior written permission.18. Legal Compliance & Member ResponsibilityYou are responsible for understanding and complying with the laws of your country of origin, of any country of transit and of Peru. The Association conducts private cultural Programs in Peru under the cultural-heritage framework set out in Resolución Directoral Nacional N° 836/INC of 24 June 2008 (Patrimonio Cultural de la Nación). Neither the Association nor the Operator authorises the transport, distribution, import, export or commercialisation of any plant material outside of the lawful, private cultural context of the Program.19. Waiver RequiredParticipation in any Program is conditional upon the prior signature by the Participant of the applicable Waiver (Waiver A - Ayahuasca Ceremonies; Waiver B - Master Plant Dieta). These Terms & Conditions govern registration, contributions and the contractual relationship; the Waiver governs informed consent, assumption of risk and release of liability. In the event of any inconsistency, these Terms & Conditions prevail on matters of contributions and registration; the Waiver prevails on matters of informed consent, risk and release. The signature of the applicable Waiver is a mandatory requirement for participation.20. Assumption of Risk & Limitation of Liability20.1 Assumption of RiskBy participating, the Participant acknowledges and voluntarily assumes the inherent risks of travel in the Peruvian Amazon, group activities, traditional ceremonies with master plants and master plant dietas, as further described and accepted in the applicable Waiver. The Programs are not suitable for individuals in acute medical or psychiatric crisis.20.2 No GuaranteesNeither the Association nor the Operator guarantees any specific outcome, healing, spiritual experience or personal-development result.20.3 Limitation of LiabilityExcept in cases of willful misconduct (dolo) or gross negligence (culpa inexcusable) as expressly preserved by Article 1328 of the Peruvian Civil Code, and to the maximum extent permitted by Peruvian law, neither the Association nor the Operator shall be liable for any indirect, incidental, special, consequential or punitive damages, nor for loss of profit, loss of opportunity, loss of data or loss of business. The aggregate liability of each of the Association and the Operator (taken separately) shall in no event exceed the total amount paid by the Participant to that party in the twelve (12) months preceding the event giving rise to the claim. Nothing in this Section limits any liability that cannot be excluded under Peruvian mandatory law, including non-excludable damages (such as daño moral where awarded by a competent court) and non-waivable consumer rights under Ley N° 29571.21. Changes to These TermsThe Association and the Operator may amend these Terms & Conditions to reflect operational, legal or safety changes. Updated versions take effect upon publication on the Website with a new “Last updated” date. The version of these Terms & Conditions in force at the time of registration governs that registration and the corresponding Program; subsequent amendments do not apply retroactively to confirmed registrations, except where required by mandatory law.22. Notices & ContactOfficial notices may be sent to the email address provided by the Participant in the registration form. Notices to the Association and to the Operator shall be sent to Asociacion-Irake@pm.me. Notices are deemed received the next business day after sending, save for proof of non-receipt.23. Governing Law & JurisdictionThese Terms & Conditions and any non-contractual obligations arising out of them are governed by the laws of the Republic of Peru (including the Peruvian Civil Code, Ley N° 29571, Ley N° 29733 and the cultural-heritage framework recognised by Resolución Directoral Nacional N° 836/INC of 24 June 2008). Any dispute shall first be addressed through good-faith written negotiation between the parties for a minimum of thirty (30) calendar days. If unresolved, the parties submit to the exclusive jurisdiction of the competent courts of Peru. Nothing in this Section limits any non-waivable right of the Participant as a consumer under Ley N° 29571, including the right to file a complaint before INDECOPI.24. MiscellaneousIf any provision is held invalid, the remainder shall remain in force. No failure or delay to enforce shall operate as a waiver. The Participant may not assign membership or any rights without the Association’s prior written consent; the Association and the Operator may assign their rights and obligations to any successor or affiliate, provided the Participant’s rights are not diminished. These Terms & Conditions are executed in English; any Spanish translation provided for Peruvian consumers under mandatory consumer law prevails to the extent strictly required by such law. These Terms & Conditions, together with the applicable Waiver, the Privacy Policy and the Operator’s written registration confirmation, constitute the entire agreement between the parties on the subject matter hereof.Acceptance. By accepting these Terms & Conditions at registration, by paying the initial contribution, or by attending any Program activity, the Participant confirms that they have read, understood and accepted these Terms & Conditions in full.
